A Power of Attorney can allow a property owner or buyer to appoint another person to complete specified real estate transactions on their behalf. This is particularly useful when the principal cannot attend a Dubai Land Department (DLD) or Real Estate Registration Trustee transaction personally.

The representative can only exercise the powers written into the document. A real estate POA should therefore be drafted around the actual transaction, whether that involves buying, selling, mortgaging, transferring or managing a property. What Is a Real Estate Power of Attorney in the UAE?

A Power of Attorney is a legal instrument through which one person, known as the principal, authorises another person, known as the attorney or representative, to perform specified acts on their behalf.

For real estate matters, the POA can give the representative authority to deal with property-related procedures within the limits stated in the document. In Dubai, the Dubai Land Department accepts transactions carried out by a legal representative where a duly legalised and regulated Power of Attorney grants the required authority.

The POA does not give the representative unlimited control over the principal’s property. The receiving authority will look at the actual wording to determine whether the representative has authority to complete the proposed transaction.

What Can a Real Estate Power of Attorney Authorise?

The powers included will depend on what the principal needs the representative to do. A property POA may, where expressly stated, authorise the representative to:

  • Buy property on behalf of the principal
  • Sell a specified property
  • Sign documents required for a DLD transaction
  • Complete ownership transfer procedures
  • Handle specified mortgage-related procedures
  • Apply for or submit documents and approvals connected with the transaction
  • Deal with a developer or relevant property authority where authorised
  • Complete specified gift or transfer procedures
  • Manage, lease or deal with a property where management powers are included

Not every real estate POA needs all of these powers. For example, someone appointed only to purchase property does not necessarily need authority to sell, mortgage or gift it.

General vs Special Power of Attorney for Property Transactions

A general POA may contain several specified powers relating to the principal’s affairs. However, the word “general” should not be understood to mean that the attorney can automatically perform every possible property transaction.

A Special or Limited Power of Attorney focuses on a particular transaction or defined set of actions. For a property sale, purchase, mortgage or transfer, a limited POA can make the representative’s authority clearer by identifying the transaction and, where appropriate, the relevant property.

The appropriate form depends on the transaction and the requirements of the authority that will receive the document.

Can Someone Buy or Sell Property for You Under a POA?

Yes. Dubai Land Department confirms that a legal proxy may transact a customer’s property under a duly legalised and regulated Power of Attorney, provided the proposed action falls within the powers granted in the POA.

This means a representative may complete a purchase or sale where the document gives them the necessary authority and the DLD requirements for that transaction are satisfied.

There is no general DLD rule requiring the principal and attorney to be immediate family members simply because the POA is being used to buy or sell property. What matters is the validity and scope of the authority granted.

How Long Is a Property Power of Attorney Valid in Dubai?

Dubai Land Department applies specific validity periods when a POA is used for certain property transactions.

  • Sale, mortgage and grant transactions: DLD states that the Power of Attorney is valid for these purposes for two years.
  • Property purchase: DLD states that the Power of Attorney is valid for purchase purposes for five years from the date of notarisation.

These are DLD transaction-validity rules. A particular POA can also be affected by its own expiry wording, revocation, completion of the authorised task or another event that legally ends the authority.

Before relying on an older document, check both the POA itself and the current requirements of the authority handling the transaction.

What Should a Property Power of Attorney Include?

A property POA should clearly identify the parties and the powers required for the proposed transaction. Depending on its purpose, the document may need to address:

  • The principal and authorised representative
  • The property concerned, where transaction-specific details are required
  • Authority to purchase or sell
  • Authority to sign transfer and registration documents
  • Authority to submit and receive relevant documents
  • Mortgage powers, if the representative will deal with a mortgage
  • Developer or NOC-related authority where relevant
  • Property management or leasing authority, if required
  • Authority to appoint another representative, if substitution is intended and legally permitted

The wording should match the actual transaction rather than relying on broad clauses that may not satisfy the receiving authority.

How to Obtain a Real Estate Power of Attorney in Dubai

The POA must go through the appropriate authorised notarial process. A private service provider may assist with drafting, document review, translation and coordination, but the legal notarisation itself takes place through the authorised notarial framework.

For a property-related POA, the process generally involves:

  1. Identifying the exact property transaction and powers required.
  2. Preparing the POA wording.
  3. Providing identification details for the principal and representative.
  4. Providing supporting property documents, such as the title deed where applicable.
  5. Completing any required Arabic translation.
  6. Submitting the transaction through the applicable notarial channel.
  7. Completing identity, capacity and signing verification.
  8. Receiving the notarised document for use with DLD or the relevant authority.

Dubai Courts provides electronic notarial channels for eligible transactions, so physical attendance at a notary office is not necessarily required in every case.

What If the Property Power of Attorney Is Issued Outside the UAE?

A POA signed outside the UAE can be used for a Dubai property transaction, but it must complete the required authentication process before DLD will accept it.

Dubai Land Department states that a foreign-issued Power of Attorney must be ratified through the applicable authorities in the country of origin, including the relevant notary and Ministry of Foreign Affairs, followed by the UAE Embassy in that country and finally the UAE Ministry of Foreign Affairs.

If the document is not in Arabic, a legal Arabic translation may also be required depending on the receiving authority and document format.

Because the overseas process varies according to the country of issue, applicants should confirm the applicable legalisation chain before sending the document to the UAE.

Can a POA Be Used for a Property Mortgage?

Yes, where the Power of Attorney expressly grants the required mortgage authority and the transaction meets DLD and lender requirements.

DLD accepts a legal Power of Attorney where a representative acts in mortgage registration and mortgage-transfer procedures. The representative’s authority must cover the relevant act, and additional documents or bank requirements may apply.

For DLD purposes, a POA used for a mortgage transaction falls within the two-year validity period described above.

What About Property Management?

A POA can also be drafted for management rather than ownership transfer. Depending on its wording, it may allow the representative to handle matters such as leasing, rent-related administration or specified dealings concerning the property without granting authority to sell it.

When Is a Real Estate Power of Attorney Useful?

A property POA can be particularly useful where:

  • The owner or buyer lives outside the UAE
  • The principal cannot attend a DLD or trustee procedure personally
  • A representative needs to complete a defined purchase or sale
  • A property owner needs someone to handle specified mortgage procedures
  • An owner wants another person to manage the property without granting wider sale authority

The main advantage is representation, not a guaranteed faster transaction. Once the required documents are complete, DLD states that a standard sale-registration transaction can itself be completed quickly, so a POA should not be presented as a way to bypass normal DLD requirements.

Check the POA Before the Property Transaction

Before using a Power of Attorney for a UAE real estate transaction, check that it covers the exact action being planned, remains within the applicable validity period and satisfies the requirements of the authority receiving it.
